«Sul tema generale della violenza nei confronti dei medici, non bastano però i necessari interventi ordinamentali, che pure sono stati adottati, come l’inasprimento delle pene per i criminali aggressori e la perseguibilità d’ufficio che, finalmente, sgrava il medico aggredito dalle difficoltà insite nella querela e attiva la procedura penale con un semplice esposto. Certamente serve più vigilanza, spesso difficile da attuare, soprattutto per presidi e ambulatori lontano dalle concentrazioni ospedaliere. È necessario anche portare l’attenzione sul clima culturale che rappresenta il terreno favorente la violenza nei confronti dei medici e degli operatori sanitari». Lo scrive Guido Marinoni, presidente Omceo Bergamo, in una lettera pubblicata ieri su ‘L’Eco di Bergamo’, commentando il caso di Barbara Capovani, la psichiatra di 55 anni aggredita e uccisa a Pisa da un ex paziente.
Secondo Marinoni «il problema dell’immagine del medico nella nostra società è più complesso e merita qualche spunto di riflessione. È, anche, un problema di comunicazione. Ad esempio, in questi giorni, si ripete che è necessaria la depenalizzazione dell’atto medico, in quanto l’attuale regime di procedibilità favorisce la medicina difensiva, che aggrava i costi di sistema. Sacrosanta una depenalizzazione che consenta più tranquillità nell’attività del medico (del resto l’atto medico è depenalizzato nella maggior parte dei Paesi), ma collegare la responsabilità del medico a un atteggiamento dannosamente (e, in modo implicito, vigliaccamente) difensivo è destruente per l’autorevolezza della nostra professione. La continua pubblicizzazione di interventi per ridurre liste d’attesa, estendere prescrivibilità, offrire servizi e tutele di vario tipo, sempre parcellari e, in realtà, microfinanziati, accredita nei cittadini una percezione di un servizio sanitario nazionale forte e tutelante, ove nulla viene negato e a tutto si ha diritto. L’immagine distorta è quella dei medici, specie di quelli più in prima linea, che si arrogano il diritto di concedere o di negare un diritto costituzionale garantito».
Per il presidente Omceo Bergamo «anche il decreto sui nuovi Lea, arrivato in porto dopo anni, sancisce l’accesso a una serie di prestazioni anche innovative, che non sempre saranno concretamente esigibili in tempi ragionevoli e, nella percezione comune (forse a qualcuno non dispiace sia distorta), il ritardo sarà colpa del medico e magari dei suoi colpevoli spazi libero professionali. Lo stesso dicasi degli infiniti andirivieni dissuasivi legati a piani terapeutici, autorizzazioni varie e della infinita burocrazia, che finisce per presentare al cittadino il medico come un burocrate arrogante invece che come un alleato empatico».
In questo clima culturale, sostiene Marinoni, «le persone arrivano facilmente a disprezzare la nostra professione e, per le frange più estreme ed emarginate, tra il disprezzo e la violenza il passo è breve. E quando la violenza esplode è provato che non è certo la minaccia di sanzioni a poterla contenere. Difficile proporre soluzioni a questa situazione, se non cercare di fare opinione, anche nella relazione personale con gli assistiti, tentando in tutti i modi di recuperare e potenziare quel rapporto personale di fiducia con i cittadini su cui si fonda il concetto stesso di “professione”. Non è facile, ma vale la pena di provarci, nella quotidianità. L’Ordine continua a rappresentare, con forza, questa situazione ai cittadini e alle istituzioni e si è attivato per promuovere “un processo di educazione” che parta dalle scuole».
