Rubino chiede a Martha Stocker di convocare i vertici del sindacato
La Corte di Cassazione ha dato ragione alla Fimmg e ha stabilito che la potestà della Provincia di Bolzano nelle materie «igiene e sanità, ivi compresa l'assistenza sanitaria ed ospedaliera, ha carattere concorrente con la potestà dello Stato e deve essere esercitata, oltre che in armonia con la Costituzione e dei principi dell'ordinamento giuridico dello Stato, nei limiti dei principi stabiliti dalle leggi dello Stato».
La Corte ha concluso che le disposizioni contenute negli Accordi Collettivi Nazionali «costituiscono principi fondamentali cui la legislazione provinciale è tenuta ad uniformarsi e che il contenuto degli accordi, dalle convenzioni stesse previsti, rappresenta principio generale di regolazione del rapporto convenzionale dei medici di medicina generale a livello nazionale».
Le convenzioni triennali che hanno per oggetto «l'erogazione delle prestazioni essenziali nella Provincia di Bolzano» possono dunque regolare autonomamente gli aspetti collaterali a quelli già definiti con gli accordi nazionali ma non possono contraddire le disposizioni contenute negli accordi stessi.
Grande soddisfazione per la pronuncia della Corte ha espresso il segretario provinciale della Fimmg Luigi Rubino.
«La sentenza interviene con estrema chiarezza in una materia conflittuale come quella della potestà legislativa concorrente e diventa un punto fermo nei rapporti tra Stato e Regioni» canta vittoria Rubino.
Rubino chiede alla neo assessora alla Sanità Martha Stocker di convocare i vertici della Federazione in un incontro che, in base al dispositivo della sentenza, valuti la necessità di un immediato Accordo integrativo che recepisca le indicazioni della Cassazione.
